Ordering

- In most cases vehicles are not held in stock and a vehicle will be manufactured specifically to meet your order and these terms and conditions reflect this.

An order requires a deposit to be paid at the time of order of a minimum of 50% of the total order price (inclusive of VAT). By providing your credit, debit or charge card details for this purpose, or cash or a cheque, you shall be placing a firm order with Secma on these terms and conditions. No order is accepted by Secma without such deposit. A higher deposit may be required in certain circumstances (e.g. multiple or fast track orders). Any payment by credit card will incur a handling fee of 2_% of the amount charged.

- Within 5 working days of receipt of any order and appropriate payment Secma will: -

1. Confirm acceptance, and the specification details, of your order

2. Provide you with a receipt for your deposit

3. Provide you with an estimated delivery date

All written communication from Secma will be by email or, if you haven’t supplied an email address, will be despatched to you by post on the day it would have been emailed (in which case please allow an additional 2 working days)

- On receipt of confirmation you should notify us immediately if you consider any of the details are incorrect .You may, immediately on receipt of Secma's confirmation, change certain details of the specification such as colour, and choice of extras, although any change of the model type will be entirely at the discretion of Secma .If Secma does not hear from you within 2 working days of a confirmatory email, or 4 working days of despatch of confirmation by post, the details set out in Secma’s confirmation shall be deemed to be the correct details of your order and an order will be placed accordingly by Secma on the manufacturer. We strongly suggest that if you have not heard from us at all within the periods set out above, you telephone us immediately to avoid any possible confusion or dispute

Cancellation Policy

- An order may be cancelled within no more than 7 days of the time and date of you placing your order provided a cancellation fee of 10% of the total order price including VAT is paid this will be deducted from the deposit.

- An order may be cancelled after 7, but no more than 14, days of the time and date of you placing an order provided a cancellation fee of 25% of the total order price including VAT is paid. This will be deducted from the deposit.

- An order may not be cancelled after 14 days without the specific, written agreement of Secma, which will only be given in exceptional circumstances.

- Cancellation must be by email or fax and simply stopping a deposit payment will not be effective cancellation. The balance of any deposit will be returned within 10 working days of receipt of notice of cancellation .Any stopping of cheque, or cancelling of payment of deposit will automatically invalidate your right to cancel your order and entitle Secma to pursue payment in full of the total order price inclusive of VAT prior to ordering your vehicle from the manufacturer. Interest at the rate of 1.5 % per month shall accrue on any unpaid deposit.

- In the unlikely event that no deposit was paid you shall pay the cancellation fee within 7 days of giving notice of cancellation.

Delivery

- You will be given an estimated delivery date at the time of your order or with your confirmation of order. This will usually be approximately 6-8 weeks from order confirmation, though this may be longer at certain times due to holidays at the manufacturer’s factory or extremely high levels of demand. Secma will provide you with a likely delivery date shortly before the estimated delivery date.

- The balance of your total order price (i.e. total order price including VAT less the deposit already paid) must be received by Secma at least 5 working days prior to the likely delivery date notified to you .The registration of the vehicle will not take place until this payment has cleared. Secma will provide you with an appropriate VAT invoice.

- If the you fail to pay such balance on time

Secma reserve the right (but shall not be obliged) to either:

1. Treat the order as cancelled and retain the deposit as payment for expenses and losses incurred, or

2. Charge interest at the rate of 1.5% per month on the outstanding balance until it is paid.

- Secma will use our reasonable endeavours to ensure that your vehicle is available for delivery by the estimated delivery date but no guarantee can be given as vehicles are made to order.

- Your Order Confirmation will stipulate whether you have requested the vehicle to be delivered to a given address, in which case the delivery charges will be included in the total order price, or that you wish to collect your vehicle from Fenny Bridges when available. If you are to collect the vehicle you can make arrangements to do so during normal office hours. If we are delivering it to you we will endeavour to agree a mutually convenient day to do so.

Servicing and warranty

- The SECMA has been designed primarily as a fun vehicle to travel relatively short distances on or off road. No warranty or representation is made by Secma as to the fitness for any specific use of any vehicle unless expressly set out in writing and signed by a director. Whilst members of staff will answer any questions in good faith, if it is a customer’s intention to rely on any statements given by staff in deciding to buy a vehicle, then it is incumbent on the customer to obtain such statement in writing from Secma, signed by a director. Secma will not normally be in a position to form a view on whether a vehicle is suitable for a particular use linked to the specific and particular needs of an individual customer, but will only be able to answer questions about the features of the vehicles.

- The warranty is only valid with proof of first service at an authorised service point giving the details of the owner, mileage, registration and chassis number of the vehicle.

- The basic warranty covers parts and labour for a period of 1 year from registration. However, if a vehicle is used for commercial purposes, (e.g. self drive hire, advertising/promotions vehicle or as a taxi) the warranty covers parts only, and only for 6 months from registration.

- The warranty does not include breakdown recovery, collection or delivery, only parts and labour whilst the vehicle is at an authorised service workshop.

- We reserve the right to replace or repair defective parts at our discretion and to require that defective parts that are replaced are returned to us.

- The Warranty is invalidated if:

- The vehicle is worked on by any workshop not previously approved in writing by Secma or Secma; or

- If the original specifications of the vehicle are modified in any way; or

- If non-genuine spare parts are used; or

- If the vehicle is subjected to negligent or unreasonable use or is overloaded in any way; or,

- If the damage is due to the inexperience or carelessness of the driver or incorrect or inappropriate maintenance; or

- If the vehicle is used for competition, self drive hire or as a taxi.

The Warranty does not extend to normal wear and tear, cables, tyres, batteries, bulbs, etc towing costs or costs consequent upon the breakdown of the vehicle.

General and limitation of liability

- No variations to these terms and conditions shall be binding on Secma unless signed by a director of the company. All orders accepted by Secma are on the strict condition that these terms and conditions solely and exclusively apply to such order, unless expressly stated to the contrary in a document signed by a director of the company.

- Secma does not limit our liability for death or personal injury caused as a result of any negligence. In any other regard Secma’s liability for any claim, or group of claims from one customer arising out of the same incident, shall be limited to a maximum of the total order price net of VAT paid by that customer for the relevant vehicle.

- Secma shall not be responsible for any indirect or consequential loss arising from any negligence or breach of contract.

Terms and Conditions for RAC Roadside Assistance as supplied by Secma Motor Company.

1. RAC cover is only available for new and unused SECMA vehicles that are registered for road use.

2. The offered RAC cover runs for 12 months from the first date of registration.

3. This cover is not transferable from the vehicles first registered owner.

4. This offer only applies to new and unused SECMA vehicles supplied by QMC either direct or through its network from 1st Jan 2007.
